Indiana Medical CBD / Low-THC Cannabis Laws

- Introduction
Indiana does not have a medical marijuana program in the traditional sense, but it does allow the use and sale of low-THC hemp-derived CBD products. Since 2017, state law has permitted qualified retailers to sell “low THC hemp extract” products containing no more than 0.3% THC. Recreational cannabis and medical cannabis with higher THC content remain prohibited.

- Qualifying Conditions
- None required – CBD products are available to any adult, regardless of medical diagnosis.
- Patient Possession Rules
- CBD extracts must contain no more than 0.3% THC
- Products must meet Indiana’s packaging, labeling, and testing requirements
- “Smokeable hemp” (including hemp flower for inhalation) is not permitted
- Product Regulations
- Products may be derived from or contain any part of the Cannabis sativa L. plant that meets the legal definition of industrial hemp
- Must be lab-certified to meet THC limit and contain no other controlled substances
- Must include clear labeling and manufacturer details
- Home Cultivation
- Not permitted for any form of cannabis, including hemp
- Retail Sales
- As of March 21, 2018, retailers in Indiana may sell low-THC hemp products to adults
