Introduction New Jersey Medical Marijuana Card ™
New Jersey, the Garden State, is densely populated, historically significant, and home to some of the strictest cannabis regulations in the country—until recently. Flanked by New York and Pennsylvania, New Jersey now permits both medical and recreational cannabis, but its regulatory structure remains more controlled than many other legal states.
Beyond cannabis, New Jersey boasts Atlantic City’s casinos and boardwalk, Liberty State Park’s sweeping views of Manhattan, the famous Cape May lighthouse, and historical Revolutionary War battle sites. But for residents and visitors alike, understanding the state’s cannabis rules is essential to staying legal and safe.

- Legalization Timeline
- 2010 – Compassionate Use of Medical Marijuana Act signed by Gov. Jon Corzine.
- 2010–2018 – Program restricted; few Alternative Treatment Centers (ATCs) licensed.
- 2017 – New Jersey leads the U.S. in cannabis arrests despite medical legalization.
- 2020 – Voters approve Question 1 with 67% support, legalizing adult-use cannabis.
- 2022 (April) – Recreational sales begin.
- 2024 – Recreational market exceeds $1.3 billion in sales.
Possession & Purchase Rules
Adults 21+:
- Up to 1 oz (28 g) cannabis flower
- Up to 5 g concentrates
- Edibles and infused products counted toward the 1 oz combined limit
Medical Patients:
- Up to 3 oz (85 g) cannabis flower per month
- Edible forms permitted as chewables, capsules, tinctures, syrups, or drops
- Note: Traditional food-based edibles (e.g., brownies, gummies) are not permitted under current regulations
Qualifying Conditions for Medical Cannabis
- ALS
- Anxiety
- Cancer (including related chronic pain or nausea)
- Chronic pain (including visceral pain)
- Crohn’s disease
- Dysmenorrhea
- Epilepsy
- Glaucoma
- HIV/AIDS (including related chronic pain or nausea)
- Inflammatory bowel disease (IBD)
- Migraines
- Multiple sclerosis
- Muscular dystrophy
- Opioid dependency or use as a substitute therapy
- PTSD
- Seizure and spasticity disorders
- Tourette’s syndrome
- Terminal illness (life expectancy < 12 months)
Taxes & Revenue Allocation
Recreational Sales Taxes:
- State sales tax: 6.625%
- Local tax: Up to 2%
- Social Equity Excise Fee: Paid by cultivators
Revenue Allocation:
- 70%: Community reinvestment in designated “impact zones” (grants, loans, business support)
- 30%: Cannabis regulatory agencies, enforcement, and prevention programs
Medical Cannabis:
- No sales tax since July 1, 2022
Home Cultivation
Home growing is not permitted for either medical or recreational users. Multiple bills have been introduced to allow limited cultivation, but none have passed.
Cannabis Delivery
- Legal for both medical and recreational use
- Must be conducted by state-licensed dispensaries
- Local municipalities may regulate or ban delivery within their borders
Consumption Rules

New Jersey offers reciprocity through a temporary 6-month MCP card for visiting medical patients.

- Impact zone reinvestment is one of the strongest equity provisions in the nation, with the majority of tax revenue targeted at communities most affected by prior cannabis enforcement.
